  • I don’t think they can ticket you on private property. But it’s odd for private property to have a stop sign. I’d fight it. Take pictures and take them to court.

    Where do you live? In most states it’s legal, if the sign is on property “wherever the public has a right to travel by motor vehicle.”

    And obviously it’s legal, since as you say, the cop sits there and tickets people.

    First of all if you know that the officer sits there regularly why would you blow the stop sign? Second when pleading innocent and appearing in court if you lose you will have to pay court fees which are much more then just paying the ticket. All you have to do to lose is for the officer to show up. I don’t think it is worth it and yes it is legal. A stop sign is a city device used to control traffic, running that sign which is put up by the city is a traffic offense, despite where it is placed. In the event of a loss in court you can still take defensive driving courses but you will pay the fine, court fees and the points will stay on your record.

    private property is still apart of a municipally.
    private property doesn’t have their own police so any area within jurisdiction rights of the department, the officer having the right to give the citation private property or not.

    if the officer of a different city wrote a ticket which he have no jurisdiction in right the ticket wouldn’t hold up. but if a sheriff or a county agency wrote it. it would be pretty solid

    You can challenge it and if you loose and you can very well plead to go to traffic school to keep the points on your DL

    Although the Vehicle Code is generally applicable only upon streets and highways, local municipalities can make the Code applicable on some private roads and private property (such as parking lots and roads around shopping malls). I think it is a very good bet that if the officer was giving tickets, he knew he had authority to do so.

    You can go to traffic school after being found guilty, though it is within the discretion of the hearing officer to allow it. If you do, the ticket will be dismissed and you will NOT have points on your record (the answer saying you will is wrong). However, since you don’t have a defense, it will probably be easier just to arrange to pay the fine and go to traffic school through the mail or on line.
